In this Privacy Policy, we provide the information regarding the processing of personal data carried out on our website, as required by the General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the Regulation). The information presented below includes the following purposes of data processing: (i) processing of personal data related to job candidates applying for open positions and administration of the candidate database; (ii) handling of complaints, requests and orders; (iii) e-mail communication; (iv) use of cookies; (v) video surveillance; (vi) conclusion and execution of agreements. This Privacy Policy also describes your rights as a data subject, the provision of data to its recipients and other conditions for the processing of personal data applicable to all data processed by the company for the purposes listed above.

Processing of Personal Data Related to Job Candidates Applying for Open Positions and Administration of the Candidate Database

If you submit your CV (resume), cover letter, references and/or other documents or data related to an open position published on our website or a specialized recruitment and job search website, the data that you submit voluntarily and other personal data listed below shall be processed for the recruitment purposes.

We will process your personal data for the recruitment purposes until we decide to hire a particular candidate, he/she completes his/her probationary period or we decide to complete the selection process without selecting any candidate. This period usually lasts no longer than four months. If you do not object to such processing of your data, after the completion of the selection process, we will keep your CV and other data submitted for the purposes of administration of our candidate database for a period of 3 years, so that when a new employee becomes required, we could contact you and invite you to participate in a new selection process or offer you a position.

Your personal data shall be processed on the basis of your consent to participate in the selection process and after the completion of the selection process it will be stored on the basis of a legitimate interest. We may also perform certain actions to comply with our statutory obligations. Submitting your personal data while participating in a selection process is voluntary, however, if you do not provide such data, we will not be able to assess your suitability for the position. You can object to the retention of your personal data after the selection procedure is completed – in such case, we will destroy your personal data and will not make any job offers in the future, unless you participate in a new selection procedure voluntarily or resubmit your personal data. If you do not agree that we retain your data after the completion of the selection procedure, please inform us accordingly when submitting your CV and other documents, by replying to our e-mail or by signing an information form during an interview.

Please note that we may exercise the right granted by the data protection legislation to contact your former employees and ask for their opinion regarding your qualification, professional skills and characteristics. We will not, however, contact your current employee without your explicit prior consent.

Handling of Complaints, Requests and Orders

If you submit a complaint, claim or request by email, in writing or otherwise, the personal data that you submit voluntarily shall be processed for the purposes of handling of such complaint, claim or request.

If your complaint or claim is related to a potential dispute, possible damage, etc. and if any contractual relations arise during the execution of an order, your personal data shall be stored for a maximum period of 10 years. If the personal data related to a complaint or a claim is not related to a potential dispute, it shall be destroyed within a shorter period, when such data is no longer necessary for achieving the purposes for which it was processed. Usually this period does not exceed 1 year.

The processing of your personal data shall be based on the expression of your free will, i.e. your consent to submit the data. However, in certain cases (e.g. in the event of a possible or actual dispute), further retention of your complaint may be required by the law.

E-mail Communication

According to the Regulation, the contents of e-mail communication are considered as personal data, even when the correspondence is conducted by the employees of the legal entities. In this regard, the contents of electronic communication and e-mail addresses are subject to the mandatory rules of personal data processing provided for by the Regulation.

The processing of your personal data shall be based on the expression of your free will, i.e. your consent, for e-mail communication and provision of certain personal data therein. In addition to that, the processing of your data may be based on the execution of a contract or obligations provided for by the law.

Your e-mail address, correspondence contents and related data shall be processed in accordance with the principle of proportionality. The data shall primarily be visible to the person with whom you communicate directly by e-mail. However, in some cases, your correspondence may be visible to other employees, e.g. in cases of internal administration, investigation of possible infringements of legislation or internal rules, during substitutions and related events and in similar situations.

The Company conducts video surveillance inside its premises (at the entrance to the premises, in the warehouse, in the garage) and on the territory (at the entrance to the territory) in order to ensure the safety of the persons and the property. Conclusion and Execution of Agreements

For the purposes of conclusion and execution of agreements, we will process the personal data that you provide during the conclusion of an agreement and the data that we receive during your execution of such agreement. If you do not provide your personal data, we will not be able to identify you and to conclude an agreement with you.

The basis for the processing of your personal data for these purposes shall be the execution of an agreement or the actions performed before the conclusion of an agreement upon your request.   • other companies of the Bauwerk-Boen group – for the purposes of internal administration, so that the company could operate.

If the above-mentioned data recipients were established outside the European Union, the personal data would be provided to them by applying appropriate safeguards, such as the standard data protection clauses approved by the European Commission.
